If Michael Luecke, a Stamford resident, completes the program successfully and stays out of legal trouble for two years, the charges against him will be expunged, ctnews.com reported.
Luecke was arrested in February after an assistant teacher caught him lying on the floor with his pants open, police said.
Before he was confronted by the other teacher, surveillance video showed that Luecke was looking out into the courtyard, police said. The video also showed six students pass while the suspect was apparently masturbating, police said.
Luecke denies that he was engaging in the lewd behavior, police said. He has said that the clasp on his pants was broken and that he was on the floor trying to close the clip, police said.
Both Stamford and Greenwich schools said Luecke passed extensive background checks to become a substitute teacher, and there were no earlier complaints against him.
After his arrest, Luecke was placed under house arrest and required to wear an electronic monitoring device, police said.
Luecke's public defender said his client had some psychiatric issues in the past but said they were now being dealt with via the Veterans Administration, ctnews.com said.
The terms of Luecke's probation require that he have no contact with minors and that he stay away from all schools and playgrounds, ctnews.com reported.
