The man, 37-year-old Mark Bivona, was found by police in a wooded area behind the hotel, slumped over with his face in mud, police said. Bivona was startled back to consciousness when the officer yelled to him and Bivona then grabbed the can and attempted to huff from it again. The officer knocked the can away from him and was struck in the leg by Bivona, who had to be physically subdued, police said.
Bivona was charged with criminal trespass, assaulting a public safety officer and interfering with an officer’s duties. He was held on a $25,000, police said.
